Terms of Sale

These Terms of Sale apply to any subscription to a paid Lampion plan. The free plan falls outside their scope: it is governed solely by the Terms of Service.

The service is aimed primarily at professionals. Where the subscriber is a consumer, the mandatory provisions of the French Consumer Code apply and prevail over any contrary clause.

Applicable prices are those published on the pricing page on the day of subscription. They are expressed in euros, excluding tax.

Applicable VAT is added at the prevailing rate. For business customers established in another EU Member State with a valid EU VAT number, the reverse charge applies.

Lampion may change its prices. Any increase is notified at least 30 days before it takes effect and gives the right to terminate without penalty.

Billing combines a monthly subscription and, where applicable, a usage-based portion computed on actual consumption (compute, storage, transfer) beyond the allowances included in the plan.

Invoices are issued monthly in arrears and made available in the console. They carry all mandatory particulars and are numbered sequentially and continuously.

Payment is made by card or SEPA direct debit, through our provider Stripe Payments Europe, Ltd. Lampion stores no card data.

Committed plans may, subject to prior agreement, be settled by bank transfer at [TO BE COMPLETED] days.

Under article L.441-10 of the French Commercial Code, late payment automatically incurs penalties at the European Central Bank rate plus 10 points, together with a fixed recovery indemnity of €40.

If a payment fails, a reminder is sent and further collection attempts are made. The account moves to "payment pending" status.

Failing settlement within 15 days of formal notice, Lampion may suspend access to paid resources. Data is kept for a further 30 days before deletion, so you can export it.

Usage-based plans are subscribed without commitment and renew monthly. You may terminate at any time from the console; termination takes effect at the end of the current period, which is already invoiced.

Committed plans are subscribed for the term agreed in the contract and renew tacitly, unless either party gives notice before the anniversary.

A consumer subscriber has 14 days to exercise their right of withdrawal (art. L.221-18 of the French Consumer Code).

As the service is supplied immediately upon subscription, you expressly consent to its performance before that period expires and waive your right of withdrawal for the part already performed, in accordance with article L.221-25.

This right does not apply to subscriptions taken out by a professional for the purposes of their business.

Lampion builds on PostgreSQL and its standard formats: you can export all of your databases at any time, without our involvement and at no cost.

No data is held back on termination: it remains exportable throughout the retention period stated in the privacy policy.

These Terms of Sale are governed by French law. In the event of a disagreement, the parties will endeavour to find an amicable solution.

A consumer subscriber may use, free of charge, the consumer mediator indicated in the legal notice, or the European online dispute resolution platform.

Failing agreement, jurisdiction is granted to the courts of [TO BE COMPLETED], subject to mandatory consumer protection rules.
